Introduction
Full terms & conditions for Totally Caked by Tracey are detailed below.  Providing a booking fee means that the terms and conditions below are accepted and understood.    

Prices
All prices are non-negotiable and priced according to the exact design, make up and size of your cake.  Following consultation or enquiry, your quote will be valid for one week only or until Totally Caked by Tracey states—this is for both cakes and celebration teas.  A non-refundable booking fee is then required to ensure your quote remains valid and a date is secured.     

Booking Fee
A non-refundable (20% booking fee comprising of the total price of your quote) is required to secure the commission of your order and your chosen date.  If the booking fee is not paid within one week then Totally Caked by Tracey reserves the right to cancel your order and any previous arrangements made.  Payment by bank transfer is preferred although cheques and cash are accepted (please make enquiries about this—cheques are not accepted for the full payment of your order unless sent within time for clearance to be made).  

Payment
Payment should be made (method by bank transfer preferred) to Totally Caked by Tracey (details will be given once an order is confirmed).  You are asked to email when electronic payments are made so that prompt acknowledgement can be given for this.   Final payment for your order should be received no later than one month before the event—responsibility for this lies with the customer as no further instruction/reminder will be sent.  Any deviation from this should be negotiated with Totally Caked by Tracey who will confirm when this has been done.  Cheques are not accepted for any full and final payment if adequate clearance time cannot be made.  For any reason that full and final payment is not received within the timeframe the order will not be released.  

Cancellations
Should you wish to cancel an order Totally Caked by Tracey reserves the right to retain any booking fee made.  If cancellation of any event takes place after the given time of one month then Totally Caked by Tracey reserves the right to seek 100% of the order in full and final payment, unless waiver is given in writing (by TCbT) for this.  Cancellations must either be made or followed up in writing to Totally Caked by Tracey and will only take effect from the date a letter or email is received.   In the circumstances of an event being postponed/re-arranged Totally Caked by Tracey will make every effort to endeavor to transfer your order providing a suitable date is available for this.  If either the date is not available or an alternative suitable date cannot be found then the order will be treated as a cancellation (please see above).   Totally Caked by Tracey reserves the right to cancel any booking/order in very unusual circumstances or circumstances beyond our control ie fire, theft, ill health or other—for which a full refund will be made (it is understood that no further compensation will be made). This will be for any order.         

Design Condition

Alteration & Changes
Responsibility lies with the customer to read and check the quote thoroughly and ask for amendment to be made—this should be done in writing and then Totally Caked by Tracey will acknowledge this for approval to be made.  All late alterations or ones which customers are wanting to change before the event should be made one month prior to the event unless any change has been negotiated and acknowledged for this.    

Totally Caked by Tracey will endeavor to adjust any design/request where possible and within reason (sometimes it is not possible according to the design or nature of the request or the amount of time given for this).   The balance of any order will be adjusted accordingly if any alteration/request affects either the cost of your order or any preparation work involved in the original design for work with has already been undertaken.   

 
Please note that each cake is made individually by hand and that although every effort is made to ensure consistency with this, a small amount of variation may occur from the design request or the picture supplied.  Totally Caked by Tracey takes good care not to replicate cakes from the picture but to incorporate elements of what people like.    

Every effort will also be made to ensure that the highest standard of produce is used for all other events and although menus/paperwork will be provided for this that Totally Caked by Tracey reserves the right to substitute produce/items for the order to be fulfilled.  

Chocolate
Caution is recommended when considering a cake decorated with chocolate in the summer time (May-September or during extending warmer times).  Totally Caked by Tracey will not accept responsibility for any cake melting once this has left our possession.  Totally Caked by Tracey has no control over the environment/temperature and cannot accept responsibility for any the melting of any cake/item once it has left our possession.  Everything possible within control however, will be done to reduce the impact on the cake.  

Home Baked Cakes
We understand the sentimental significance of having a family member bake your cake, which you may request us to ice/decorate.  Whilst Totally Caked by Tracey is happy to do this for you, responsibility cannot be accepted for anything not made by us and we are not able to guarantee consistency, taste or standards for this (icing/redecoration will only apply to fruit cakes and not sponge).  We will not be held accountable for anything involved with this—please ask us for further advice.   

Flowers
Advice on the use of fresh flowers with your cake/order can be given on request.  Totally Caked by Tracey uses only food safe products purchasing fresh organic and edible flowers from Maddocks Farm Organics in Devon who work under strict guidelines and rules.  Totally Caked by Tracey does not work with florists to provide flowers for cakes unless the source of the product can be guaranteed—if customers wish to use flowers on cakes once a delivery is made then Totally Caked by Tracey accepts no responsibility for this.  Customers are advised to take care with variety as some are poisonous and remember that allergy can occur.  A useful link is provided for this https://www.maddocksfarmorganics.co.uk/     

Allergies & Special Dietary Requirements

Special Diets
All dietary and allergy requirements should be discussed before an order is placed.  Cakes can be made gluten/dairy and alcohol free.  Please be aware that although ingredients such as nuts can be removed from cakes or produce, that these are still used in our kitchen and so no guarantee can be given for this.  

Non-edible Items
Most cakes contain small proportions of inedible items; it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption e.g. support dowels in tiered cakes, ribbon, wires in sugar flowers, Swarovski crystals, flower picks & flower tape etc.

Delivery Conditions
Delivery charges are calculated on a mileage and time basis although some cakes can be collected from us.  If you choose delivery, it is our intention that your cake will be delivered in perfect condition prior to the start of your event. However, we ask for patience with factors that may be beyond our control (e.g. traffic conditions) as we cannot be held liable for any such delays.  In some circumstances, we may recommend the cake be delivered 1 day in advance.  It is your responsibility to ensure you inform us of your correct ceremony and event time plus the postcode of the venue to be used.  In the unlikely event of late delivery, the maximum compensation will be a refund of the delivery price. Totally Caked by Tracey cannot be liable for any damage rendered to the cake at venue once we have confirmed with a staff member and this has been placed.   If a customer chooses to collect/delegate another person to do this on their behalf Totally Caked by Tracey will not be held liable for any damage to the cake once this has left our premises.  Tiered cakes are mostly at risk during transport; we highly recommend clients check that their wedding insurance covers any damage which may occur to the cake/produce.  Any late requests for a delivered item (after securing the booking based on collection) will be accommodated where possible although cannot be guaranteed and an additional fee may be applied.  

Cake Setup
Totally Caked by Tracey provides this service free of charge to clients if prior arrangement is made.  Clients are only charged for delivery (if not provided locally) and additional payment is only added for travelling time where a venue is further away.   If a cake is moved by venue employees after delivery has been made and verbally signed off with a member of staff (photos will be taken of the cake in situ) Totally Caked by Tracey accepts no responsibility for any damage incurred after the event. Extra care should be taken with venues to ensure that a stable cake table is provided and that for weddings where marquees are involved that the flooring is level and left safe for the cake/produce to be stood.    

Storage & Consumption

Damage
Please remember that cake decorations are very delicate items; no responsibility can be accepted for damage after cakes/produce has been delivered.  Should damage occur after the event and repair is required we will advise a client accordingly of any additional cost.   

Portion Guide
Portion information should be used as a guide only and clients should note that sizes will vary dependent on how a cake is cut.  

Best Before Date/Storage Conditions
Your cake is baked to ensure it is fresh for the date of your event, the quality of course cannot be guaranteed if this is not consumed within 2 days.  We endeavor to provide the highest quality ingredients and use natural products in our cakes/for events and so would like to remind clients that the shelf life is reduced because of this.  Most supermarkets/stores of course use both preservatives and additives to prolong shelf life.  Should a client which to freeze any leftover cake thought should be given to the icing as this will condensate once thawed and this may need recovering again.  Food hygiene also only recommends that food should only be frozen for a maximum of 3 months.  If you plan to keep any of the cake please advise Totally Caked by Tracey and a box will be left.  Otherwise all packing will be removed to ensure that the venue is left tidy for the event.  Sugar paste cakes should not be refrigerated, as it will cause condensation to form on the surface of the icing. Refrigeration also accelerates the staling of the flour in the cake.

Catering  
All terms and conditions above apply as above to all items provided for events.  Crockery for this will be provided free of charge and setting up, washing up and clearing away will be listed in the price.  Any breakages made by guests will be the responsibility of those hiring services and should be paid in full in any event that breakages occur.  

Hire of Cake Stands/Accessories
Most cake stands can be used by clients free of charge although an additional charge may be applied if items have to be collected from venues further away.  Please ask for further details of those which can be hired out—deposits for these may vary depending on the value of the item involved.  Any damage to those either hired or borrowed will incur an additional charge.  Arrangements for the use/hire of stands should be agreed with Totally Caked by Tracey prior to an event.  Deposits for damage of a hired item will be returned if the item is returned in one piece/subject to no damage or breakage of this.   

Complaints
Totally Caked by Tracey asks that clients notify us upon collection/delivery of any event so that opportunity can be given to rectify any complaint.  Please note that refunds will not be given in the event that someone has a change of mind.  In the unlikely event of late delivery, the maximum compensation will be a refund of the delivery price. We ask for patience with factors that may be beyond our control (e.g. traffic conditions) as we cannot be held liable for any such delays. Refunds are at the discretion of Totally Caked by Tracey.
